On January 15th I emailed all 9 members of the Board with a signed request from 6 member households (really 9 individuals, but I'm only including member households) for a Special Meeting to discuss the major expenditure the Board wishes to make to enter into a lawsuit against a member. I also posted the notice here and at the mailboxes on the bulletin board. Regardless of how you believe this issue should be handled, we deserve to have a meeting of the members to decide such a major issue, and at least be fully informed. To date, none of the petitioners have received any reply. Today, the notice I posted at the mailboxes was torn down. I will repost it. This is how our board treats requests for information or cooperation with it's members. The Board states that it does this under the guise of "professionalism" according to their letter of 1/10/14.
This is not the first time we have been treated to no response by this board.
On September 9th, 2013 I sent a legal request via US Postal mail to each GHPOA board member which precisely followed WV State codes 31, and 36 governing non-profits and HOA’s as well as the Internal Revenue code governing 501-(C)-3’s, requesting to either have copies of, or view the RECORDS OF THE ASSOCIATION, to which I am entitled as a member BY LAW. I did not go through a lawyer as this is not necessary, and should not be necessary. Truly, I should simply be able to ask and view records without a written request if all was as it should be.
My request was totally ignored by the members of the GHPOA.
I found out that the records were being stored at the office of Attorney, Braun Hamstead in Ranson, whom the GHPOA has hired to represent them. I emailed Mr. Hamstead requesting permission and on September 25th I viewed and photographed about a year's worth of records. During this 1.5 hours at the attorney's office I was supervised by a staff attorney for which I assume the association was charged.
Since I have substantial experience as an accountant, a B.S. in accounting, experience as a Chief Financial Officer of a large corporation, and 6 years experience in a CPA firm preparing Financial Statements and Tax Returns, I undertook to do a review of this financial information as best I could from photographs of the records.
I will be posting the results of my examination and my recommendations here in more posts. I hope you find the reading interesting.
